1.2. Payment: Payments are processed as described in the booking process. The Company is not responsible for any financial disputes between Guests and property owners or managers.
2. Property Listings
2.1. Accuracy: While we make reasonable efforts to ensure the accuracy of property descriptions, you acknowledge and agree that Galiano Stays is not responsible for discrepancies between property listings and the actual property conditions.
3. Hold Harmless Clause
3.1. Assumption of Risk: By utilizing our services, you acknowledge and assume any and all inherent risks associated with vacation rentals. You expressly accept and assume all such risks.
3.2. Release of Liability: You unequivocally release and discharge Galiano Stays from any and all liability for personal injuries, damages, losses, accidents, or incidents of any nature that may occur during your stay. You acknowledge that Galiano Stays is absolved of any responsibility for property damages, accidents, injuries, or any other issues related to the vacation rental.
3.3. Indemnification: You agree to indemnify, defend, and hold Galiano Stays harmless from any claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising from your use of our services.
4. Cancellation and Refund Policy
4.1. Cancellation: Cancellation policies are established by property owners or managers and vary by property. It is your responsibility to review and understand the cancellation policy specific to the property you are booking.
5. Governing Law and Jurisdiction
5.1. Applicable Law: These Terms are governed by the laws of the state of New York, USA. Any disputes shall be exclusively resolved in the state and federal courts located in New York.
6. Changes to Terms
6.1. Modifications: We reserve the right to modify or update these Terms at any time. It is your responsibility to review them periodically. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
